Abstract
Global South Asia’s domestic courts reportedly delivered many judgments innovating new
practices and settling principles for environmental justice. The paper discusses the evolution of
environmental law as a pertinent part of the human rights regime from a South Asian perspective and
the role of the judiciary in promoting environmental justice. It highlights the region's diverse
ecosystems and the increasing impact of climate change, emphasizing the importance of environmental
litigation in enforcing environmental laws and protecting the region's natural resources. Hence this
paper presents key case studies from Bangladesh, India, Pakistan, and Nepal, showcasing how the
judiciary in these countries has upheld environmental principles and provided remedies for
environmental harm.
